Man Found Guilty of Murder Twice Sentenced Monday

Glenn Allen Smith found guilty in homeless murder case expected to be sentenced for second-degree murder Monday.

Glenn Allen Smith, 50, a homeless drifter found guilty of murder twice is expected to be sentenced 9 a.m. Monday for a second-degree murder charge at the Story County Courthouse.

Smith is accused of stabbing Danny McGonigle, another homeless man, to death during a fight in May of 2008. Smith and McGonigle got into a fist fight and wrestling match near a wooded area south of the Department of Transportation after spending the day drinking May 19, 2008.

Smith walked away from the fight with a scrape to his knee and cuts on his hand. McGonigle died on the way to the hospital. He had 32 stab wounds to his face, neck and chest area.

A jury found Smith guilty in April 2009. However a district court judge set aside the verdict in December 2009, when attorneys argued that the verdict was contrary to the evidence and Smith was granted a new trial. Smith maintains he killed the man in self defense.

Smith's second trial began May 29 and jurors once again found Smith guilty of second degree murder in June.
